Guarantee of conformity
We are required to deliver goods that conform to the contract and we answer for any lack of conformity existing at the time of delivery.
Goods conform when, among other things:
- they match the description, type, quantity and quality we published;
- the pack contains the number of pieces stated, in the colours listed, in the sizes you allocated;
- the fibre composition matches what is labelled;
- the measurements fall within the stated ±1 cm tolerance of the published chart;
- they are fit for the ordinary purpose of a garment of that kind and show the durability you may reasonably expect of it.
You have two years from delivery to act. A lack of conformity appearing within 24 months of delivery is presumed to have existed at delivery, so the burden is on us, not on you.
You choose between repair and replacement. Where neither is possible, or where the chosen remedy would take an unreasonable time or cause you significant inconvenience, you may ask for a price reduction or cancel the sale and be refunded in full.
Using this guarantee does not stop you also relying on the guarantee against hidden defects.
Guarantee against hidden defects
Separately from the guarantee of conformity, we answer for hidden defects in the goods sold — defects that make them unfit for their intended use, or that so reduce their use that you would not have bought them, or would have paid less, had you known.
The claim must be brought within two years of discovering the defect, within the general 20-year limit running from delivery.
Under this guarantee you may choose between:
- cancelling the sale and being refunded the full price against return of the goods;
- keeping the goods and being refunded part of the price.
A defect is only hidden if it was not apparent at the time of sale and you could not have discovered it by an ordinary examination. For textiles this typically covers latent weaknesses in a yarn, a seam or a dye that only appear in normal use.
How these differ from the 14-day withdrawal right
The right of withdrawal is for changing your mind: 14 days, no reason needed, return postage at your cost, and the pack goes back complete and unworn.
The two guarantees on this page are for when something is wrong with the goods. They run for years rather than days, they cost you nothing including postage, and worn garments are covered — wear is the normal way a defect shows itself.
If something is faulty, use the guarantees. Do not use the withdrawal route: you would be paying postage on a claim that should cost you nothing.
How to make a claim
- Write to support@dplclothing.shop or call +33 6 16 75 50 35 (Monday to Friday, 09:00–17:00 CET), or write to 3 Rue de la Varenne, 36700 Châtillon-sur-Indre, France.
- Give your order reference, say which pack and which piece is affected, describe what is wrong and when it appeared, and attach photographs where you can.
- We answer within 2 working days, tell you which guarantee we are handling the claim under, and send you a prepaid return label if the goods need to come back.
- We repair, replace or refund. Where a single piece from a pack is defective, we replace that piece — you do not have to return the whole pack under a guarantee claim.
Note the difference: a withdrawal returns the whole pack, but a guarantee claim on one faulty piece is settled on that piece.
Costs
Making a claim under either guarantee is free. We pay return postage, and repair, replacement or refund is at no cost to you. We never charge a handling or restocking fee on a guarantee claim.
Commercial guarantee
We offer no additional commercial guarantee. Nothing on this site limits, shortens or replaces either legal guarantee, and no clause in our terms may be read as doing so.
